Failure to do so would “unnecessarily raise greater doubts as to whether the elections in Lucerne County were ‘honestly, efficiently and uniformly conducted,'” the lawsuit argues.
The application seeks a court order compelling the Election Commission to complete ballot adjustments before certifying election results.
Bognett also seeks a clear mandate that the board “never waive any aspect of the settlement process.”
County election officials did not immediately file a response to Bognett’s lawsuit. However, they plan to finalize the settlement by 5 p.m. Wednesday and plan to prove the election results on Monday.
Cartwright responded to the submission, claiming that Bognett was “a series of lawsuits in the event that the election matter doesn’t go his way”, claiming that Cartwright had already won re-election.
